Terms & Conditions
These terms govern every booking, service authorization, delivery, payment, and use of media produced by Future Listing Media.
Agreement to Terms
By submitting a booking or approving services after these Terms & Conditions are presented or linked in the booking form, quote, invoice, email, text message, or other written communication, the client agrees to the version in effect on the date the services are authorized. A person booking for a brokerage, team, company, seller, or other party represents that they have authority to act for and bind that party.
Booking, Payment & Responsibility
Invoices are due in full within seven (7) calendar days from the invoice date, unless a different due date is stated in writing by Future Listing Media. Payment must be received as cleared funds.
Unless Future Listing Media agrees in writing to bill another party, the person who places or authorizes the order is responsible for all charges. Naming a brokerage, team, seller, owner, or other third party on a booking or invoice does not transfer that responsibility or make payment contingent on reimbursement. Payment is not contingent on a property sale or closing, MLS activation, or the performance of a marketing campaign.
Overdue balances accrue simple interest at 10% per year or the maximum rate permitted by applicable law, whichever is lower, beginning on the day after the applicable due date and continuing until paid. Completed or authorized services remain payable even if delivery access or media usage rights are suspended or terminated.
Accepted: Zelle, ACH/Bank Transfer, Credit Card.
Rescheduling & Cancellation
Rescheduling is free if requested at least 24 hours before the appointment.
Same-day cancellations are subject to a $49 fee. No-show appointments, including locked properties or unavailable access, may be billed up to the full service amount.
Turnaround Times
Photos: The next day, including weekends.
Video: The next day, including weekends.
Complex projects or substantial add-ons may require additional time. Rush delivery is available for an additional fee, subject to availability.
Revisions & Edits
Services include two (2) rounds of revisions. Additional rounds are billed at $30 per round.
Revisions cover reasonable editing adjustments within the original scope. Re-edits caused by property changes, staging, renovations, or a changed creative direction may require a new paid booking.
Property Preparation
The client must ensure that the property is photo-ready. We do not clean, declutter, or move furniture.
If the property is not ready, we may photograph it as presented. Property condition does not qualify the client for a refund or complimentary re-shoot.
Media Ownership, License Activation & Nonpayment
All photographs, video, drone media, floor plans, graphics, and other deliverables remain the intellectual property of Future Listing Media. No copyright ownership is transferred to the client.
Full cleared payment of all amounts due is an express condition precedent to any license or usage right. Review galleries, previews, download access, possession of files, or early release of unwatermarked media do not grant permission to publish, upload, distribute, modify, or otherwise use the media before full payment.
After full cleared payment, the client receives a limited, non-exclusive, non-transferable license to use the media solely to market the specific property identified on the applicable booking or invoice, including use on the MLS, authorized listing portals, the ordering client’s website, and the ordering client’s social media in connection with that property.
If payment is not received within seven (7) calendar days from the invoice date, any temporary, provisional, or implied permission is automatically terminated without further notice. The client must immediately stop using the media, remove it from the MLS, Zillow, Realtor.com, websites, social media, advertisements, and all other platforms under the client’s control, and promptly request removal from any other platform to which the client supplied the media.
The payment obligation survives any suspension or termination of usage rights. Once all outstanding invoice amounts, lawful interest, and applicable charges are received as cleared funds, the limited license will be reinstated prospectively, provided no other material breach remains uncured. Payment does not retroactively authorize use that occurred while no license was active.
AI Editing, Alterations & Transfers
Unless Future Listing Media gives prior written permission, the client may not materially alter the media or create derivative versions, including through generative AI, virtual staging, object replacement, sky replacement, structural modification, or misleading digital manipulation.
The client may not sell, sublicense, transfer, or provide the media to another agent, brokerage, builder, vendor, owner, or third party for separate use. Uploading paid and properly licensed media to the MLS and its authorized syndication partners solely to market the specific property is permitted and does not transfer ownership.
Drone & Weather
Flights depend on FAA regulations, airspace authorization, site conditions, and weather. If conditions are unsafe, the drone portion will be rescheduled at no additional charge when reasonably practicable.
Liability Limitations
We are not responsible for delays, outages, compression, cropping, removal, or other actions caused by third-party platforms such as the MLS, Zillow, or social networks.
To the fullest extent permitted by law, Future Listing Media’s total liability for a project is limited to the amount actually paid for that project. This limitation does not apply to liability that cannot lawfully be limited or excluded.
File Storage
Files are stored for three (3) months after delivery. After that period, files may be permanently deleted. Archival retrieval, if available, may require an additional fee.
Safety & Conduct
We reserve the right to pause or stop a shoot when unsafe, unlawful, threatening, or materially disruptive conditions arise. Services affected by unresolved access, safety, or conduct issues may be billed as a cancellation.
Chargebacks, Collections & Enforcement
A returned or reversed payment, unresolved chargeback, or payment default immediately suspends all media access and usage rights until the full balance and any lawful, documented payment-processing charges are resolved. A client disputing part of an invoice must still pay all undisputed amounts by the original due date.
For an unpaid account or unauthorized media use, Future Listing Media may suspend gallery access, preserve and document evidence, submit notices to platforms when legally appropriate, refer the account to a collection provider, and pursue available contractual, copyright, court, or other legal remedies.
To the extent permitted by law, the client is responsible for reasonable collection costs, court costs, and attorneys’ fees incurred to enforce payment or media rights. A delay or failure by Future Listing Media to enforce a provision does not waive that provision or any later breach.
